Eben Moglen, Columbia University Law Professor, will head the newSoftware Freedom Law Center (SFLC). An initial 4 million dollars has been provided by Open Source Development Labs (OSDL) to fund the project.

The law center will provide free legal service for open source projects and developers. In 2004 OSDL established a separate $10 million Linux Legal Defense Fund providing legal support for Linus Torvalds, Linux kernel creator and end user companies subjected to Linux-related litigation by the SCO Group. The new law center will not be affiliated with the OSDL.

“This is about taking care of the goose that laid the golden egg and not letting wolves come in the middle of the night and steal it away,” Moglen said during a press conference. “This is a legal firm not involved so much in litigating and defending as it will be for counseling and advising and nurturing non-profits and to prevent millions of dollars in litigation.”

Moglen will serve as chairman and director-counsel of the non-profit organization. Also on board as directors are: Lawrence Lessig, law professor at Stanford Law School; Daniel Weitzner, director of the World Wide Web Consortium‘s technology and society activities; and Diane Peters, general counsel at the OSDL. Daniel Ravicher, executive director of the Public Patent Foundation, will help manage as legal director.

Moglen, one of the world.s leading experts on copyright law as applied to software, will run the new Law Center from its headquarters in New York City. The Law Center will initially have two full-time intellectual property attorneys on staff and expects to expand to four attorneys later this year. Initial clients for the Law Center include the Free Software Foundation and the Samba Project.

Other services provided by the SFLC include: asset stewardship, to avoid intellectual property claim conflict; license review and compatibility analysis; legal consulting and lawyer training.

Health Canada orders recall of contaminated toothpaste manufactured in India

The government department responsible for the health of Canadians, Health Canada, issued a warning to Canadians not to use a brand of toothpaste found to contain “unacceptable levels” of diethylene glycol (DEG).

The toothpaste is branded as India Neem Active Toothpaste with Calcium and is manufactured by Calcutta Chemical Co. Ltd. in India. Although the toothpaste is not approved for sale in Canada, it has been found on store shelves in Western and Atlantic Canada. It is also possible, though not confirmed, that the product may be found in stores across Canada.

Toothpastes that have been approved for sale in Canada will have on the packaging either an eight-digit Drug Identification Number (DIN) or a Natural Product Number (NPN).

Consumers have been advised by Health Canada to discontinue use of the suspect toothpaste and ensure that the product remains out of the reach of children. As per Health Canada instructions, consumers are to return the toothpaste to the store from which they purchased it.

Health Canada describes DEG as “a poisonous chemical used in antifreeze and as a solvent. It may cause nausea, abdominal pain, dizziness, urinary problems, kidney failure, breathing problems, lethargy, convulsions, coma and even death when ingested.” DEG has been used by makers of counterfeit products as a cheaper alternative to using common sweeteners.

To date, Health Canada has not been made aware of anyone becoming sick from using India Neem Active Toothpaste with Calcium.

There is an increased concern for DEG-containing toothpaste with respect to its use by children. While most adults do not ingest toothpaste, it is often swallowed by young children. Chronic exposure to DEG, according to Health Canada, “is a particular concern in specific vulnerable populations such as children and consumers with kidney or liver disease.”

This current warning from Health Canada follows a similar recall of 24 brands of toothpaste from China, including some counterfeit Colgate brands, which were found to contain not only DEG, but also high levels of a harmful bacteria from the Enterobacteriaceae family. Information on the specific genus was not provided.

To obtain more information on the recall, consumers are advised to call Health Canada’s public enquiries line at 1-866-225-0709.

With the 2014 Winter Paralympics set for March, Wikinews sought comment from U.S. Representative Jackie Speier, who serves California’s 14th congressional district about the event and how current U.S. policies impact people with disabilities. Elected to the U.S. House in 2008, she serves on the Committee on Oversight and Government Reform and the House Armed Services Committee. For the first time ever, the Paralympics will be broadcast live in the U.S. on network television.


((Wikinews)) : Will “Obamacare” have a positive or negative impact on the lives of people with disabilities?

Jackie Speier: By-and-large the Affordable Care Act will have a significant and lasting beneficial impact on persons with disabilities […] Most importantly, pre-existing conditions will no longer prevent persons with disabilities from obtaining health insurance. Lifetime limits on medical expenses will be removed and preventive services will be free. All of these provisions of the law create health insurance that is highly supportive of good health outcomes for everyone, but in particular for those who have a disability.

((WN)) : Are there any Paralympic athletes or elite athletes with disabilities from your district that people should know more about?

Jackie Speier: There are currently two Paralympic athletes who train or live in my district that people will definitely hear more about in the coming years. One is a young woman named Allie Hyatt who trains in Judo with Willy Cahill, [whom] I have also trained with. Allie, who is visually impaired and just 15, has already won numerous awards and will participate in the Youth Olympic Games next year. She is sure to be a force in the Judo world for many, many years. Hyatt lives in San Francisco and Cahill is the founder and CEO of the Blind Judo Foundation.

Another great athlete is Mohamend Lahna who is training for the Rio Olympics in 2016 for the paratriathlon,” Speier continued. “He is from Morocco originally but lives now in San Mateo and trains daily at the College of San Mateo. He runs marathons with a prosthetic leg and has his sights set on winning several medals atworld and Olympic events in the future. Lahna has proximal femoral focal deficiency (PFFD), a birth defect that affects the hip and pelvis. He is married and has a 1-year-old child.

Wikinews also sought comment from other members of Congress, including John K. Delaney, Mike Honda, Kyrsten Sinema, Eric Swalwell, Raúl M. Grijalva and Ann Kirkpatrick but at publication time, had received no response.

An Oklahoma police officer is on paid administrative leave, following an altercation with ambulance personnel while they were transporting a patient to the hospital. Trooper Daniel Martin, a member of the Oklahoma Highway Patrol (OHP), was caught on video by his police vehicle’s dashboard-camera in a physical struggle with paramedic Maurice White, Jr. after Martin pulled the ambulance over. Martin had previously passed the ambulance while en route to another call, but came back and pulled over the ambulance. The incident occurred on May 24, and footage from the police dash-cam was released following a tort claim filed by paramedic White.

It has also been suggested that the previous call had in-fact been to pick up his wife from a police station who was then present in the car during the incident between Martin and the ambulance.

Footage by the OHP released Friday shows the ambulance personnel repeatedly informing Trooper Martin that they have a patient in the back of the ambulance that they are in the midst of transporting to the hospital. Martin yells at the ambulance driver for making what he claims was an obscene gesture – the ambulance driver asserts he raised both hands signalling confusion at the police officer’s actions. Trooper Martin can be heard telling the ambulance driver “I’m going to give you a ticket for failure to yield, and when I go by you saying ‘What’s going on?’ you don’t need to give me no hand gestures now, I ain’t going to put up with that [expletive], do you understand me?”

The video from the police dash-cam is eight minutes long, and paramedic White can be seen twice being pushed up against his ambulance by Trooper Martin. In one instance, Martin shoves White up against the ambulance while gripping his neck tightly with his other hand. In a written statement, paramedic White described the hold placed on him by the Trooper, stating “he engaged my trachea in a claw-like grip digging his nail into my neck while partially shutting off my air supply.”

[Paramedic Maurice White, Jr.] never once became aggressive to that trooper.

The sister of the patient in the ambulance, Clara Harper, was following the ambulance and witnessed the incident. Harper later viewed the footage from the police dash-cam, and she stated to Tulsa World paramedic White “never once became aggressive to that trooper.” She asserted that “He did nothing wrong.” After the ambulance was allowed to continue transporting the patient to the hospital, Harper got into the ambulance to be with her sister. “She was scared, and I was trying to calm her down and telling her everything was going to be all right,” said Harper.

My biggest concern was for the patient. If there’s any nightmare from this, it’s because of what that mother, that patient, had to go through.

Paramedic White was interviewed by KOKI-TV, and recounted his thoughts as the incident was taking place. He stated his main concern was for his ambulance patient: “It was surrealistic because I’ve never had such an experience. My biggest concern was for the patient. If there’s any nightmare from this, it’s because of what that mother, that patient, had to go through.” White’s attorney told KOKI-TV that if White deemed the arrest to be unlawful, he had the right to resist it. White is a paramedic for Creek Nation Emergency Medical Services in Oklahoma. He told FOX News he was surprised at the actions of the police trooper. “He’s taken an oath, just as I have, to protect and serve. I could not believe that this was happening,” said White.

The Oklahoma Department of Public Safety decided to release the police dash-cam video publicly after amateur video of the incident was posted to the video-sharing website YouTube. Captain Chris West, spokesman for the OHP, explained why the video was not released earlier. “We’ve been well aware of the fact that this incident has drawn enormous attention, but made the decision to protect the integrity of the investigation, any and all relevant evidence, as well as the rights of the department employees,” said West. Prior to the release of the dash-cam video, a relative of the patient had posted video of the incident to YouTube. The son of the ambulance patient can be seen in a video stating to the camera “Highway patrolman pulled over my mom’s ambulance because he’s mad we didn’t pull over, and he tried to arrest … the EMT from taking my mother to the hospital.”

One man is there protecting a patient and one man is there abusing his authority and throwing his weight around.

Richard O’Carroll, the lawyer for paramedic White, said that Trooper Martin abused his authority as a police officer. “Everything on this needs to relate back to why are we here? One man is there protecting a patient and one man is there abusing his authority and throwing his weight around,” said O’Carroll. White’s attorney filed a tort claim on behalf of his client in order to get the video of the police vehicle’s dash-cam released. Trooper Martin’s lawyer says he did not realize a patient was in the ambulance at the time of the incident.

O’Carroll explained the decision of paramedic White not to use sirens while transporting his patient to the hospital: “There was a reason he wasn’t running sirens. There was a suggestion of chest pains and a heart condition and sirens aggravate these conditions by increasing the blood pressure.” However the attorney for Trooper Martin, Gary James, said that the ambulance was not exempt from regulations because it did not have its sirens on. “If they’re not running their sirens or lights, they don’t get afforded any emergency vehicle exemptions,” said James. The OHP chief is handling an internal review into the incident. As of June 1, Trooper Martin has been on paid administrative leave.

Joseph Cerniglia, a chef who had appeared on Gordon Ramsay’s television show Kitchen Nightmares, has commited suicide. Cerniglia was the owner of Italian restaurant Campania. He jumped off a bridge into the Hudson river on the New York–New Jersey border. At the time of filming in 2007, Cerniglia owed suppliers $80,000.

Officials reported that 39-year-old Cerniglia had jumped off of the George Washington Bridge into the Hudson. His death has officially been ruled as suicide. His body was retrieved from the river after reports of a man jumping off of the bridge.

Ramsay released a statement to the Press Association saying “I was fortunate to spend time with Joe during the first season of Kitchen Nightmares. Joe was a brilliant chef, and our thoughts go out to his family, friends and staff.”

Cerniglia told Ramsay about his personal debt when he came to the restaurant in 2007. He said “I am financially in trouble. The debt of the restaurant alone is overwhelming. My personal debt — wife, kids, mortgage — that’s a lot of debt”.

Lose 10 pounds in a week and you’ll likely just gain it right back. Likely you’ll gain more than you lost over time. Slowly the scale moves… higher and higher… Yo-yo diets got the name for a reason. It’s up and down and up and down. Here are 5 tips to stop the upward march to higher weight.

1. Pick a plan.

Diets mostly don’t work for real weight loss. But short term eating plans can help greatly with a long term plan. If nothing else a quick “weight loss” lets you see something happen. That’s partly because real sustainable weight loss only happens at a slow pace, a pound a week or so. Motivation to stick with it is often lacking just because of the slow pace of change.

2. Write it down.

Commit to what you decide on for a definite period of time. Make a game of it. If you deny yourself something, substitute something else you like. Tell somebody what you’re doing. Be accountable. Stay on track and don’t give up and give in.

3. Keep moving.

Increased metabolism means more fat burned. Start some form of activity to get moving. Anything is a plus. Stop reading about weight loss and get out and move. Truly the right type of activity is more the key to success than is a tricky eating plan. In addition adding activity is simpler than many eating plans too. Especially muscle toning and building activities add up to more fat burned even when you aren’t exercising at all. That’s called a raised basal metabolism and that means a body that’s a good burner of fat.

4. It’s the carbs.

Likely the carbs have got you. It’s the sugars and the carbohydrates that balloon most of us and ruin our health. Look into balanced plans that limit, but not eliminate carbohydrates. Also, realize that bodies are mostly made of proteins and fats. That’s why those are so important and cannot be left out of the weight loss plan. If low fat foods and diets worked so well, surely more people would succeed with fat loss since for years low fat foods have been all the rage. Limiting the fats is part of the puzzle but surely not the complete answer for sure.

5. Fill up.

Make something that’s a filler part of the plan. Soups, for example, fill you up, but don’t necessarily contain what makes you fat. Try homemade soups that contain lots of fillers but very few calories. That way the soup can help in the battle against hunger while not adding a lot of calories that must be eliminated somehow.

You can lose 10 pounds in a week. Please make that effort part of a long-term plan. Otherwise all that pain is for nothing. You’ll be worse off the more often you do a short diet. Yo-yo diets actually lead to fat gain and weight gain over time rather than producing weight loss.
