Las Vegas ‘chili finger’ woman has history of lawsuits

Anna Ayala, the Las Vegas woman who claims to have found the notorious “chili finger” at a Wendy’s outlet in San Jose, California, has filed lawsuits against other businesses, according to researchers at the Associated Press. Her previous court battles included the national El Pollo Loco chicken-chain, a previous employer, and even General Motors.

Ayala successfully won her suit for medical expenses against El Pollo Loco, after her daughter Genesis contracted salmonella poisoning from eating at the restaurant. However, Ayala lost another suit in 2000 claiming that a wheel fell off her car.

Ayala’s original account of the incident spoke “emotionally and with disgust” to the San Jose Mercury News when she described it to the paper.

“Lies, lies, lies, that’s all I am hearing. They should look at Wendy’s. What are they hiding? Why are we being victimized again and again?” Ayala recently told The Associated Press. Ayala is now in her Las Vegas home, avoiding reporters.

“It doesn’t prove anything,” family spokesman Ken Bono told the San Francisco Chronicle. “My mom has 10 lawsuits. A lot of people have lawsuits. Why would she sue for money? She has plenty of money,” he said.

Nick Muyo, a spokesman for the San Jose Police department, said not to expect new information in the case for at least a week.

“We just want to step back and take a deep breath,” Muyo told Knight Ridder Newspapers. “From a law enforcement point of view, once you establish it is a human finger, you have to wonder is this a case of industrial accident or is this a case of unreported homicide,” he said.

Las Vegas police searched Anna Ayala’s home on Wednesday, retrieving a cooler and other effects from her home, such as a makeup case.

Despite the incident, which has dramatically reduced sales at Northern California Wendy’s outlets, die-hard Wendy’s fans are still turning up for lunch, even at the outlet where the finger was found, at 1405 Monterey Highway, just south of downtown San Jose.

“We’ve eaten here for years,” a police officer told the San Francisco Chronicle under the condition that he remain anonymous. “They’re very nice people. When we work Spartan Stadium, we always eat here,” he said.

San Jose City Council candidate Andrew Diaz still eats the chili. And he witnessed the finger discovery.

“I walked away real slow,” Diaz told the San Francisco Chronicle. “I didn’t want any commotion,” he said.

A lorry spilt thirteen tonnes of raw fish on a road in the small British town of Shaftesbury, Dorset, earlier today.

Crates of iced fish, worth £80,000, apparently burst out the rear doors of the lorry as it climbed a hill.

The BBC reports Dorset Police as saying “It appears as the lorry started its ascent up the hill the load in the rear of the articulated container slipped backwards, probably on the wet floor, and the weight of the fish on the rear doors forced the doors open.”

The clean-up was hampered by poor weather conditions as Dorset County Council struggled to use a digger and a second lorry to clear the fish.

On Thursday, Scotland’s First Minister and Scottish National Party (SNP) leader Alex Salmond set the date September 18, 2014, for the country’s referendum on political independence from the rest of the United Kingdom. The question to be presented at the ballot is: “Should Scotland be an independent country?”; if a majority vote “Yes”, the union of the parliaments, in-place since 1707, will come to an end.

According to the Australian Broadcasting Corporation (ABC), the SNP believe Scotland would be more prosperous under self-government controlling their own resources, including the oil, fishing and farming industries.

The vote comes from what Salmond describes as a chance “to build a better country”. Salmon urged the Scottish population to seize the opportunity for independence, quoted by ABC as saying, “[t]he choice becomes clearer with each passing day – the opportunity to use our vast resources and talent to build a better country, or to continue with a Westminster system that simply isn’t working for Scotland,”

However, Independence opponent and Scottish Labour leader, Johann Lamont claims the SNP have failed to detail how an independent Scotland would support itself. Lamont told the The Guardian that Salmond has failed to explain how the new nation would deal with health care and education issues, as well as what its polices would be on tax, pensions and welfare.

For this election only, the voting age of the September referendum has been lowered to 16. Polling expert Prof John Curtice told the BBC: “If you look at the polls in the round, what you discover is, yes, younger people are perhaps a little more likely to be in favour of independence.” However, the Professor was sceptical if younger voters would be the all-deciding vote that the SNP believes them to be.

ABC reports opinion polls show only 30% of the Scottish population currently support independence, with 50% favouring the status-quo as part of the the United Kingdom.

An elderly woman who was a crossing guard or a “lollipop lady” has been killed in an accident involving a truck in Glasgow, Scotland. The woman has been identified as 59-year-old Catherine Gibson, who came from the Dennistoun district of Glasgow. At around 0850 GMT on Thursday, Gibson was assisting children in crossing a road as part of her job near St. Anne’s Primary School, located in the east side of the city. Gibson was suddenly struck by a truck and dragged underneath the wheels of the vehicle. The children being assisted witnessed the entire collision.

After the accident occurred, Gibson was transported to a hospital but died shortly afterwards. The truck driver, who is aged 64, was not injured in the crash. The vehicle itself was taken away from the scene of the accident at approximately 1200 GMT on the same day. A person working in a garage near where the accident occurred said: “There were children waiting to cross the road and they were all screaming and crying. They all ran back from where the accident had happened. She was found face down and it looked as though the lorry had driven over her shoulder. She was alive when she was found but died a short time later. It was horrific and the kids will probably need counselling.

“It could have been a case of the driver not being able to see her because the vehicle is quite high as he caught her on the passenger side. It’s not clear whether she gave him enough time to stop or whether the driver has failed to stop. It was snowing as well so that could have been a factor.”

Louise Jarvie is the head teacher of St. Anne’s Primary School. “Our thoughts and condolences are with the family at this very sad time,” she said in reference to the incident. “Support and counselling for pupils and staff will be available to anyone who needs it.”
